Terms of Service Domain Names & Dispute Policy Billing Terms Privacy Policy
Note: For the purpose of this document Niki Molnar MBE trading as NM Consulting will be referenced as NM Consulting. Datalinked, nm-hosting and nm-hosting.co.uk are product names of NM Consulting.
Service:
Prompt payment is necessary to ensure uninterrupted service of your account.
For credit card customers, you will be automatically charged the appropriate amount at the beginning of your account's billing period. For cheque/money order customers, NM Consulting must receive your cheque/money order by the beginning of your billing period. Late payments, credit card refusals, expirations, chargebacks and disputes are subject to fines, suspensions and account terminations at NM Consultings discretion. All unpaid balances incurred during period of service by NM Consulting are subject to collection or further restrictions, set out below.
Please note: There is no refund for a domain registrations/renewals or Dedicated Server fees, if they were not cancelled in writing within 30 days of renewal.
Payment Terms and Non or Late Payment Penalties:
As consideration for NM Consulting providing domain name registration or website hosting services to you, you agree to pay NM Consulting, prior to the approval of the desired domain name registration or hosting setup, the amounts set forth in the NM Consulting Price Schedule, as amended from time to time, for the initial registration of the domain name & any subsequent renewals, and for website hosting.
Invoices
All invoices are due within 14 days of invoice date, excepting if an invoice includes payment for hosting services or domain registration or renewals, whereby payment is due by return. It is usual that NM Consulting requests between one-third and one-half pre-payment for project work and this must be cleared before any work can begin. If there are due dates, or project deadlines/timings agreed (whether in a contract or not), these dates will be pushed back by the same amount of time that any pre-payment is overdue.
Domain Names
Your application will not be registered until NM Consulting receives actual payment of the registration fee. If NM Consulting does register a domain name prior to payment of the registration fee, NM Consulting reserves the right to restrict use of the domain name until payment has been received. If payment is not forthcoming within 90 days of registration or renewal, the domain name registration shall be transferred to NM Consulting as the paying entity for the registration. Transfer of the domain name will be prohibited and access to the domain name (if hosted by NM Consulting) shall become inaccessible to the client until such time that full payment (including any reinstatement fees) have been paid.
Website Hosting
Website hosting charges are to be paid in advance either in full for a complete year, or monthly, as agreed with NM Consulting. All website hosting services will be suspended if payment is outstanding for more than 30 days. If still outstanding after 90 days, the website hosting account will be cancelled and all data, code, server-stored documents, emails, etc. will be deleted during this operation. It is the client's responsibility to hold a backup of all data, code and emails, etc. held on the hosting server and NM Consulting will not be responsible for any loss that the client sustains due to its data being deleted after 90 days of non-payment. The process is irreversible.
Other Services
If payment for other NM Consulting services are outstanding (i.e. any services that are not domain registrations, domain renewals or domain hosting) and are overdue for 60 days or more, then NM Consulting reserves the right to suspend domain and website hosting services until such time that the total amount outstanding to NM Consulting is paid.
Chargebacks and Penalties
All fees must be prepaid and are non-refundable, in whole or in part, even if the domain name registration is suspended, cancelled or transferred prior to the end of the registration term.
In the event of a charge back by a credit card company or other payment provider authorized by NM Consulting, the domain name registration shall be transferred to NM Consulting as the paying entity for the registration. NM Consulting may reinstate your domain name registration at its sole discretion upon its receipt of the registration or renewal fee and its then current reinstatement fee. The reinstatement fee is currently UK £250.
Payment must be made by credit card or other methods we indicate in registration application or renewal form. We make no commitment to renew your domain for you upon its expiry, however we may contact you before the expiry date to remind you.
Cancellations of Hosting or Domains
Any request for cancellations must be received via regular post to NM Consulting and you will receive a confirmation upon the cancellation of your account. Cancellations over the telephone and informal email cancellations are not accepted.
Submission of the cancellation form does not automatically complete the cancellation request - your account may be past due or delinquent in which case the balance must be settled before cancellation of an account can be possible. Domain name transfers, non-usage, Internic problems, ISP problems, or any other secondary issues not directly related to NM Consulting's services does not qualify an account for cancellation. Customers are urged to make sure that they receive a cancellation confirmation from NM Consulting, indicating the closure of a domain and/or an account has been completed. Refunds will be given at the discretion of the Company Management.
Cancellation of Coding Services
An invoice will be raised for work already completed and will be due within 14 days of invoice date.
Bandwidth Charges
Any traffic overage will be billed at the end of each month. Traffic overage will be calculated using monthly traffic data (collected via MRTG and/or server logfiles) used minus the accounts allowance. This will be billed at the current rate per gigabyte. NM Consulting shall have the right to take corrective action if a customer's bandwidth is excessive and interrupts service for other customers. Such corrective action may include the assessment of additional charges, disconnection or discontinuance of any and all Services
Payment Options
Payment options are as follows:
Credit / Debit Cards: NM Consulting accepts Mastercard, Visa, Visa electron, Switch and Solo credit/debit cards via PayPal.
Cheque Payment: NM Consulting cannot guarantee that a service will be provided until after any received cheques have been cleared.
Standing Order: NM Consulting cannot guarantee that a service will be provided until after any standing orders have been received.
Refunds
Refunds will be given at the discretion of the Company Management.
Special Offers
Special offers may sometimes be available through our website or other sources. Special offers are only valid between specific dates that will be mentioned on our website. If a special offer is not available when you renew your services then the full current price must be paid in order to renew any services that were received at discount or free of charge.
